USS Carl Vinson moving to San Diego

WASHINGTON, March 30 (UPI) -- The USS Carl Vinson aircraft carrier

will move¢ö

from its homeport from Bremerton, Wash.,

to San Diego, Calif.,

the U.S. Navy

announced ¢ö¢ö¢ö

Friday.

The Nimitz-class nuclear-powered ship has been refueling and getting an overhaul in Newport News, Va.

After a thorough review of prospective homeports,

the secretary of the Navy selected San Diego

as the preferred alternative after evaluating a number of factors,

including its existing infrastructure,

family support facilities, and proximity to training areas.

The decision is subject to a supplemental environmental impact statement,

the Navy stated.

Two other nuclear-powered carriers are stationed

in San Diego,

the USS Ronald Reagan and

the USS Nimitz.

Having six of our aircraft carriers

in the Pacific

greatly enhances

our nations security ¢ö¢ö¢ö¢ö¢ö¢ö¢ö

said Secretary of the Navy Donald C. Winter.

It will help protect

our vital interests ¢ö¢ö¢ö

reassure ¢ö

our

friends and allies ¢ö¢ö¢ö

and maintain ¢ö¢ö¢ö¢ö¢ö¢ö¢ö

unfettered access to sea lanes.

The 2006 Quadrennial Defense Review called for

the basing of six of the Navys 11 carrier strike groups

in the Pacific.

The Navy decided in 2000 to homeport three carriers in San Diego.

The Vinsons air wing is already based in San Diego,

giving that location an edge.

The Navy was considering Bremerton and Everett in WashingtonState, San Diego, Hawaii and Guam as homeports for the Vinson.

The ship will be moved in early 2010.

The USS Carl Vinson launched the first missiles ¡©¡©¡©

in the October 2001

attack ¡©

on the Taliban in Afghanistan.

Carl VinsonCarl Vinson (November 18, 1883 – June 1, 1981) was a Democratic United States Congressman from Georgia. He was the first person to serve for more than 50 years in the United States House of Representatives.

Vinson was born in Baldwin County,

Georgia,

attended GeorgiaMilitaryCollege,

and graduated with a law degree from MercerUniversity

in 1902.

He was elected to the Georgia House of Representatives

in 1909.

After losing a third term following redistricting,

he was appointed judge of the Baldwin County court,

but following the sudden death of Senator Augustus Bacon,

Representative Thomas W. Hardwick was nominated to fill Bacons Senate seat and Vinson announced his candidacy for Hardwicks seat in Congress.

Vinson won over three opponents.

He was

the youngest member

of Congress

when he was sworn in on November 3, 1914.

MOSCOW - A leading Russian lawmaker called Friday for

constitutional changes¡©

that would allow President Vladimir Putin

to stay in office beyond 2008,

Russian news agencies reported.

Sergei Mironov, the speaker of the upper house of parliament, said

the presidential term

Lèse majesté(French expression,

from the Latin Laesa maiestas or Laesae maiestatis (crimen),

(crime of) injury to the Majesty; in English,

also

lese majesty or leze majesty)

is the crime of violating majesty,

an offense against the dignity of a reigning sovereign or against a state.

This behaviour was first classified as a criminal offense against the dignity of the Roman republic in Ancient Rome.

In time, as the Emperor became identified with the Roman state

(the empire never formally became a monarchy),

it was essentially applied to offenses against his person.[1]

Though legally the princeps civitatis

(his official title, roughly first citizen)

could never become a sovereign,

as the republic was never abolished,

emperors were to be deified as divus, first posthumously but ultimately while reigning, and thus enjoyed the legal protection provided for the divinities of the pagan state cult; by the time it was exchanged for Christianity, the monarchical tradition in all but name was well established (an example of the way the Roman religion was made to serve the political elite).

In the (mainly Christian) states emerging after the fall of Rome the style of Majesty and the notion of offenses against it were exclusively related to offenses against the crown.

In feudal Europe, various real crimes were classified as lèse majesté even though not intentionally directed against the crown, such as counterfeiting because coins bear the monarchs effigy and/or coat of arms.

However, since the disappearance of absolute monarchy, this is viewed as less of a crime, although similar, more malicious acts, could be considered treason. By analogy, as modern times saw republics emerging as great powers, a similar crime may be constituted, though not under this name, by any offense against the highest representatives of any state ( e.g. all heads of state, regardless of their title, as in Belgium).

Few countries still prosecute lèse majesté. One exception is Thailand, where social activists like Sulak Sivaraksa were charged with the crime in the 1980s and 90s because they allegedly criticized the King[2]although the King in his 2005 birthday speech said he would not take lèse majesté charges seriously any more. Several high-profile cases were dropped. In September 2006, the leaders of a military coup accused prime minister Thaksin Shinawatra of lèse majesté; the Thai military is thought to be highly loyal to the king.[3] Although the King is held in great respect by many Thais, he is also protected by lèse majesté laws which allow critics to be jailed for three to 15 years. Politician Veera Musikapong was jailed and banned from politics for lèse majesté, despite the palaces opinion that the remarks were harmless. Frenchman Lech Tomacz Kisielwicz

who in 1995 committed lèse majesté

by making a derogatory remark about a Thai princess while on board a Thai Airways flight in international airspace was taken into custody upon landing in Bangkok and charged with offending the monarchy. He was detained for two weeks, released on bail, and acquitted after writing a letter of apology to King Bhumibol Adulyadej.

In 2007, a Swiss resident of Thailand was charged with this crime after spray painting images of the king in a drunken episode.[4] Deposed Premier Thaksin Shinawatra and his political opponent Sondhi Limthongkul both filed charges of lèse majesté against each other during the 2005-2006 political crisis. Thaksins alleged lèse majesté was one of the stated reasons for the Thai militarys 2006 coup.[5][6][7][8]
Brunei is another country which will still prosecutes lèse majesté.

In the United States and most western democracies, except for Poland, the right of free speech protects verbal attacks on public officials, as long as they are not accompanied by threats of violence.

- A Swiss man was sentenced to 10 years in prison Thursday

for spray-painting graffiti

over images of Thailands revered king,

the first conviction of a foreigner in at least a decade

under strict Thai laws

protecting the monarchy.

Oliver Rudolf Jufer, 57,

who had pleaded guilty to five counts of

lese majeste,

or insulting the monarchy,

had faced a maximum sentence of 75 years in prison.

Judge Phitsanu Tanbukalee said

Jufer was given a reduced sentence

since he had admitted his wrongdoing.

His court-appointed lawyer, Komkrit Kunyodying,

called the penalty appropriate for the crime he has committed,

adding he did not yet know

if his client planned to appeal.

The Swiss Embassy issued a tempered criticism.

We respect the Thai justice system, said Jacques Lauer,

deputy chief of mission at the embassy in Bangkok.

However, we consider the implementation of the Thai penal code

regarding

lese majeste

cases

a tough one.

Jufer was caught by surveillance cameras on Dec.

5 spray-painting black paint

over five outdoor posters of King Bhumibol Adulyadej

in the northern city of Chiang Mai, where he lived,

police and prosecutors said.

His lawyer said

he was intoxicated during the act.

Bhumibol, the worlds longest serving monarch,

is greatly loved by Thais and regarded by some as semi-divine.

He is protected from reproach

by strict laws

that forbid any criticism of the monarchy.

The vandalism coincided with Bhumibols 79th birthday,

which was celebrated across Thailand with fireworks and prayers.

Jufer, who was shackled at the ankles and dressed in an orange prison uniform,

was expressionless

as the verdict was announced.

He made no comment to reporters

as he was ushered out of the courtroom.

His case casts

a rare spotlight

on

Thailands

strict

lese majeste

laws,

which have remained virtually unchanged

since the countrys first criminal code in 1908 despite the overthrow of an absolute monarchy in 1932.

Jufers March 12 hearing was closed to the media

to minimize publicity of his offense against the king,

but

journalists were allowed into Thursdays sentencing.

Thai television and newspapers

have relied on

foreign news agencies

to cover the trial.

The Thai media and people

in general

almost never make controversial comments about the king in public.

Bangkoks Criminal Court said

its national database,

which goes back a decade,

showed that

no foreigner had been convicted

of

lese majeste

charges in

at least 10 years.

A handful of foreigners have faced

similar charges

in the past,

but

most eventually were deported to their home countries.

though few such laws are as draconian.

One step beyond - Henry VIII equated

lese Majeste

with Treason

The concept of

lese Majeste

(Eng: injury to the Majesty)

as a crime goes back to ancient Rome and was jealously guarded by absolute monarchs in medieval Europe,

while something similar existed in Asian cultures.
In Brunei, which like Thailand is ruled by a monarchy, three men were jailed for a year in 2006 for sending mobile phone clips judged seditious and insulting to Sultan Hassanal Bolkiah and his family.
Laws protecting the dignity of a monarch have been borrowed by many modern republics.
In the Indian Ocean state of the Maldives, three journalists were sentenced to life in 2002 for insulting the president and setting up a newsletter critical of the government.

In Poland, a member of the European Union, you can technically get up to three years for offending the president.
That protection is extended to any foreign head of state visiting the country. Thus police arrested 28 demonstrators in 2005 who were protesting against President Vladimir Putin of Russia, a country which has not enjoyed good relations with its western neighbour at the best of times.
The chief concern about insult laws among human rights campaigners is that they can be used to stifle freedom of expression.

A basic right

Freedom of speech is one of the most basic human rights, a spokesperson for Amnesty International told the BBC News website.

No state should be prosecuting any individual for expressing an opinion held peacefully.
Amnesty is not quibbling with laws on defamation or incitement which, it says, rightfully exist in any state to protect individuals and the community.
But other than these recognised limits on freedom of speech, there should be no restrictions, it argues.

Rebellious or rude?

Freedom of speech was not,

strictly speaking,

at issue in Thailands prosecution of Oliver Jufer, who admitted spray-painting several portraits of the king while drunk.
Many in Thailand see King Bhumibol as an anchor of stability
It was the idea that being rude about a government was a very bad idea - it hurt the government but was technically not treason because no act of rebellion was committed, Prof Ronald Hutton of BristolUniversity told the BBC News website.
In the days before the idea of constitutional opposition, any opposition was regarded as criminal and anybody who spoke against the government had to be prosecuted because it could incite rebellion.
If the concept now sounds obscure in that other leading contemporary monarchy Britain, it is thanks to King Henry VIII (1491-1547), who took personal injury one step further.

But Henry VIII passed an act which made speaking against the king treason in itself so lese Majeste became redundant.
Before anyone gets unduly anxious about offending Queen Elizabeth, it should be pointed out that British parliamentarians dealt with that part of Henrys act long ago.
Since the 1790s, Prof Hutton points out, Britain has had freedom of speech legislation which covers most of what was once Treason-by-words.
